Why Truck Accidents Happen in San Diego
Large trucks represent 9% of all motor vehicles registered in the United States, according to the National Safety Council (NSC). Many truck drivers take precautions while they travel. However, some do not — and they cause accidents that harm other motorists and pedestrians.
There are many reasons why truck accidents take place in San Diego, such as:
Speeding
Truck drivers face tight deadlines, and they may be tempted to travel above the posted speed limit. If a truck driver speeds, they may be unable to stop in enough time to prevent an accident. In this situation, the truck driver is responsible for the accident.
Intoxicated Driving
The dangers of drunk driving are significant. Truck drivers are aware of these dangers but may still choose to get behind the wheel while intoxicated. If a truck driver causes a drunk driving accident, they can face criminal and civil charges.
Fatigued Driving
It is a truck driver’s responsibility to operate their vehicle in accordance with hours of service regulations. If a truck driver ignores these regulations, they may operate their vehicle while they are fatigued. An exhausted truck driver is increasingly prone to accidents.
Poor Weather or Road Conditions
A truck driver may try to blame weather or road conditions for an accident. No matter what the driver says, they must consider these conditions before they operate their vehicle. Otherwise, if a truck driver gets into an accident and cites the weather or road conditions as the cause, they can still be held responsible for the incident.

When You Should File a Truck Accident Claim
There is a two-year statute of limitations for personal injury cases in California. If you are involved in a trucking accident in San Diego, you have up to two years from the date of the incident to file a personal injury lawsuit. Failure to file your claim during this period means you are 100% responsible for any damages you have incurred.
A truck accident lawyer in San Diego understands the role of negligence in personal injury cases. If a trucking driver was negligent and caused your accident, your attorney will encourage you to sue them. On top of that, your lawyer will urge you to pursue the most compensation you can get.
California has no limitations on the amount of compensation you can ask for in a personal injury case. You can ask for economic damages based on your medical bills, lost wages, and other quantifiable losses relating to your trucking accident. Also, you can request non-economic damages for subjective harm, such as the pain and suffering you dealt with due to your truck accident.

What to Expect Once Your Truck Accident Lawsuit Is Filed
A truck accident attorney in San Diego works with you to build your case. They review evidence with you and make sure you can present a strong argument to a judge or jury. Your attorney keeps you up to date if the defendant in your case proposes a settlement, too.
The defendant in your case may offer a settlement if they believe a judge or jury will rule against them. If you approve the settlement, you may only receive a fraction of the compensation you initially requested. On the other hand, accepting the settlement allows you to quickly get money without having to go to trial.
If you have an experienced personal injury attorney at your side, you can reduce your risk of accepting a lowball settlement. Your lawyer can help you assess a settlement offer and all that it entails. They will help you get a fair settlement, even if you have to move forward with a trial.

How You Can Get Compensation if a Family Member Dies in a Trucking Accident
If a family member is killed in a trucking accident, you can seek damages on their behalf. This requires you to file a Los Angeles wrongful death claim. You can partner with an attorney who can submit your wrongful death lawsuit to seek damages from any at-fault parties.
In a wrongful death truck accident lawsuit, you must show a judge or jury that the driver was negligent. Your attorney can help you gather and review evidence to support your claim. They will build an argument with you that helps you make it clear to a judge or jury that damages should be awarded.
A wrongful death lawsuit can take months or years to complete. The defendant in your case has the option to propose a settlement prior to your trial date. If no settlement agreement is reached, you and your attorney present your argument, and a judge or jury makes a decision on your case.
