Uninsured Drivers Can Face Criminal Charges in Los Angeles
The state of California legally requires drivers to obtain car insurance before they operate a motor vehicle. Drivers must carry a set minimum amount of insurance in order to avoid criminal charges. However, some drivers violate this rule and drive without insurance.
You should contact a police officer after many accidents in California, including those involving uninsured drivers. Inform the police officer that the other driver does not have insurance when they arrive at the scene of the accident.
Drivers who are uninsured or underinsured can face fines and other legal penalties.

Compensation for Accidents Involving Uninsured Motorists
Many drivers worry that they will not obtain compensation for their losses if they are struck by an uninsured motorist in Los Angeles. However, you may still be able to get compensation in these situations. A car accident lawyer can work to help you secure damages for your:
- Healthcare related losses
- Vehicle repair costs
You may be able to get some compensation from your own insurance policy. Uninsured/underinsured motorist insurance can kick in after an accident involving an uninsured motorist. This can provide you with some of the funds you need to cover your losses after a wreck.
Additionally, you have the option of pursuing a lawsuit against the driver who struck your vehicle. Find out more about your legal options by contacting us to speak with the team at the Simmrin Law Group.
Fault for Accidents Involving Uninsured Drivers in Los Angeles
You should be aware that a driver will not be automatically responsible for an accident just because they don’t have insurance. Your lawyer will need to prove that the other driver caused your collision for you to get full compensation. The Simmrin Law Group can work to establish fault by:
- Reviewing the police report of your accident
- Interviewing any witnesses to the collision
- Going over the scene of the wreck
- Accessing video surveillance of the accident
We can use the evidence gathered in our investigation to build a strong claim for you. Note that you can be held at-fault for an accident with an uninsured driver. However, if you strike and injure an uninsured driver, they may not be able to seek full compensation from you.
California uses “No Pay, No Play” rules to handle uninsured drivers. This means that uninsured drivers cannot generally receive compensation for their pain and suffering after an accident.
