Steps to Take Following a Workplace Injury
The most critical step is safety and immediate medical care, if necessary, and making medical staff aware that your injuries are work-related. If you are severely injured, have someone contact emergency medical services, either on-site or by calling 911. If you don’t need medical prompt attention, schedule an appointment as soon as possible.
Notify the Supervisor or Employer
Notify the immediate supervisor of your injuries. Paperwork will need to be filled out and submitted. You should receive a copy of all paperwork relating to your injuries.
Some work-related injuries are not sudden occurrences but happen over time, like repetitive motion injuries. When you become aware of the injuries, report them to your supervisor.
Document the Accident
If possible, document any contributing factors in the accident through photos. Pictures can be vital evidence in proving a workers’ compensation claim, and a workers’ compensation attorney in Burbank can use them as solid proof of why the injuries occurred. Also, ask for contact information of any witnesses to the accident who can give a first-hand account of what happened.

Compensation for Burbank Workplace Accidents
Employees are entitled to specific benefits following an injury at work. However, it may require a Burbank workers’ compensation attorney to ensure you receive the maximum benefit coverage you need. Benefits include:
- Medical treatment for the injury, which can include diagnostic testing, medications, physical therapy, and rehabilitation
- Mileage reimbursement for medical travel to appointments
- Temporary disability at two-thirds of the average weekly wage
- Permanent disability when a permanent loss of function is experienced, and payment is based on a percentage scale accounting for loss with maximum payments allotted each week
- Supplemental job displacement or retraining benefits
- In the event of a fatal accident and wrongful death, benefits paid to family members
Employers provide these benefits to ensure care for employees when injury occurs. However, the insurance companies that provide this coverage save money with minimal payouts. Simmrin Law Group ensures you work with a Burbank workers’ compensation lawyer who is familiar with insurance practices and will relentlessly pursue the maximum compensation.

When Lawsuits Are Necessary
A third party may be responsible for your injuries in a work accident. When this occurs, a lawsuit may be necessary to require the company, manufacturer, subcontractor, or property owner to pay for your injuries. There are many reasons this is necessary, and some examples include manufacturing defects on equipment parts, vehicles, or machinery.
When your job requires you to work off-site and in other locations, it is an owner’s responsibility to secure a safe environment, and a failure to meet this duty of care can result in a premises liability claim.
When this happens, vital safety records and documentation may need to be subpoenaed as proof of the defect or dangerous circumstances that caused your injuries. Getting the help you need may be difficult, but Simmrin Law Group only works with teams dedicated to uncovering unsafe products and practices.

Reasons a Burbank Workers’ Compensation May Be Denied
Having a claim denied is one of the most helpless feelings someone can experience other than an initial injury. There are reasons this happens and steps you can take to fight back.
Filing Was Delayed
Injured employers have 30 days to report their injuries to a supervisor. Even though this much time is allotted, never wait to report an injury. Any delays in reporting slow down the turnaround time for compensation.
The Injury Does Not Meet Legal Guidelines
The insurance company may determine your injuries are not severe enough to meet the legal requirements to receive workers’ compensation. Legal arguments can be defended on both sides. Having experienced representation to fight for compensation can make a difference in insurance companies’ stalling tactics.
This practice is why it is imperative to seek medical attention to begin formal documentation of the injury. Attending all follow-up appointments and prescribed medical rehabilitation therapies is necessary.
The Evidence Does Not Support the Claim
Initial documentation in any accident can make a difference in a quickly processed claim and the denial of compensation. Successful appeals are built on solid evidence and the support of a Burbank personal injury team fighting for your workers’ compensation. Insurance companies may also blame your injury on a pre-existing condition, so any information that can be gathered to support your claim is needed.
Work with a Burbank Workers’ Compensation Attorney
Household, personal, and medical bills do not wait for claims to be processed. They begin arriving almost immediately after an injury has occurred, and the compensation you are offered may only cover a small portion of your needs for medical care.
