Comparative Negligence and Car Accidents in Los Angeles
Your case may involve comparative negligence if you were partially to blame for a car accident in California. Comparative negligence is used to handle cases where more than one person was responsible for an accident.
The state of California can use comparative negligence laws to determine how much compensation you should receive after a motor vehicle collision. Generally, comparative negligence is expressed as a percentage. Let’s look at an example to help you better understand comparative negligence:
Driver A is involved in a car accident. He changes lanes without looking carefully and another driver rear-ends him. However, Driver B was exceeding the speed limit by a significant amount and engaging in reckless driving, so they are both liable for the accident. The court determines that Driver A is 40% responsible for the accident. This means he can only get 60% of the possible compensation for his injuries and other losses.
