There is no arguing about the convenience of traveling with Uber. By clicking through an app, customers get door-to-door service, and if they want to enjoy a few drinks, do not have to worry about arranging for a designated driver.
Even with these positives, Ubers are still ordinary vehicles subject to accidents, just like any others on the road. However, Uber-involved accidents can bring added complications. If you are injured in an Uber accident, your best way forward is with an Arcadia car accident lawyer from Simmrin Law Group.
Steps to Take After an Uber Accident in Arcadia
There are steps you should take following any motor vehicle accident. In the case of an Uber-involved accident, you must take additional actions to protect your claim.
After Any Motor-Vehicle Accident
First, make sure you and the others involved are safe. If you are too injured to move, stay still and wait for emergency care to arrive, and if you can move the vehicle, get out of the way of traffic, and help others do the same. Be sure to get medical care to treat and document your injuries as soon as possible.
Get evidence from the accident scene in the form of photos or videos and gather contact information from witnesses. These should include the accident environment, including road conditions, traffic signals, and other relevant details, as well as damage to the cars involved and your injuries.
Call authorities so they can make an official accident report. Depending on your role in the accident—for example, if you are the driver of another involved vehicle—call your insurance company to report the accident, but keep your comments brief and factual.
After an Uber Accident
You should always get contact and insurance information from other drivers, including Uber operators. If you are a passenger in the Uber vehicle, take a screenshot of your “ride” in the app.
Report the accident to Uber, whether you are a rider, an Uber driver, or a third-party driver. Again, stick to the facts and be mindful not to include any speculative comments or “extra” information. To avoid saying anything that could risk a settlement or increase your liability, speak with an Uber accident lawyer in Arcadia before communicating with Uber or the at-fault party’s insurance company further.

Put Your Case in the Hands of an Experienced Arcadia Uber Accident Attorney
There are a variety of potential at-fault parties and victims in an Uber accident. There are also more potential insurance companies involved. Uber has a specific insurance structure for its drivers, who are independent contractors and not employees of Uber. This status protects Uber from liability should an accident occur.
If the Uber driver holds fault for the accident, the insurance protocol is:
- Drivers use their own personal coverage when not active on the Uber app.
- When active on the app and awaiting a ride request and if the driver’s personal policy does not apply, Uber provides third-party coverage: $50,000 per person for bodily injury, $100,000 for bodily injury per accident, and $25,000 for property damage per accident.
- When drivers are active on the app and driving to a pickup or transporting passengers, Uber provides $1 million for third-party liability, uninsured motorist insurance for bodily injuries, and “contingent” collision coverage. If the driver has coverage through their personal policy, Uber covers the cash value of the car after a $2,500 deductible.
While these criteria seem straightforward, you can expect whatever insurance company to look for loopholes to exploit and avoid paying compensation. Do not engage in these discussions, as you will only become frustrated and may lose out on what you deserve. Trust these negotiations to an experienced Uber accident attorney in Arcadia.

Determining Negligence for an Uber Accident in Arcadia
Your lawyer will know which insurance company to hold accountable by investigating your accident and determining the negligent party. Simmrin Law Group has the resources, experience, and connections needed to look into the details of the accident comprehensively. The process may reveal the at-fault party is:
- The Uber driver
- A third-party driver
- A careless pedestrian, though it is rare for a pedestrian to be found fully negligent
- A violent Uber passenger
- The Uber company
Most often, the company cannot be held liable. However, your attorney may discover that a driver was not properly vetted or disciplined for previous accidents. Your lawyer can compile evidence to prove the company’s culpability.
If the Uber driver is responsible, your attorney will review the timing of the accident to discern whether the driver’s personal or Uber insurance is accountable for compensating you. If a third party caused the incident, your lawyer will negotiate with their insurance company.

Your attorney will assess your losses with precision and demand a settlement amount covering:
- Property damage: As a third-party driver, your vehicle may need to be repaired or replaced. Passengers, pedestrians, and drivers alike may have lost other valuables in the accident, such as phones, laptops, or luggage.
- Wages lost during recovery: Your injuries will probably require recovery time that takes you out of work. Severe injuries may prevent you from working again.
- Medical issues: You may need intense, immediate care or rehabilitation, or permanent long-term care.
- Suffering and distress: Your physical suffering and emotional distress matter. Your attorney will calculate an amount acknowledging these losses and your reduced quality of life.
