When to File a Bus Accident Lawsuit
As of June 2022, monthly ridership on California buses and other public transportation totaled 60 million, according to CalMatters. Riding on a bus in San Diego offers a great option to safely and affordably get around the city. However, a negligent bus driver can cause an accident, and this can prompt a personal injury lawsuit.
Some of the reasons why bus accidents happen include:
Lack of Experience
A bus driver may lack proper training. If the driver makes a mistake behind the wheel, they can cause an accident. At this point, the driver and their employer can be held responsible.
Distracted Driving
If a bus driver loses focus behind the wheel, they cannot travel safely. This driver is a liability. They may be more prone to accidents than other drivers.
Intoxicated Driving
It is a bus driver’s responsibility to follow the rules of the road. If a driver violates impaired driving laws, they can face serious penalties. On top of these, the driver and their employer can be subject to personal injury lawsuits.
Poor Vehicle Maintenance
A bus company must commit the time, energy, and resources to repair its vehicles and keep them running at peak levels. If a defective bus remains in operation, safety and performance problems can come up while a driver is using it. The driver may even lose control of the vehicle, resulting in an accident.
At Simmrin Law Group, we encourage you to reach out to us if you have been involved in an accident for these reasons or any others. Our San Diego bus accident attorney can take a look at your case. We will help you get the damages you deserve.

How Much Time You Have to File a Bus Accident Lawsuit
California has a statute of limitations that lasts two years for personal injuries. This statute gives you a maximum of two years from the date you suffer a personal injury to pursue damages from anyone responsible for it. If you choose not to file a lawsuit during this period, you cannot do so at a later time.
A bus accident lawyer in San Diego can submit your request for compensation before the statute of limitations to do so runs out. Your attorney will urge you to ask for economic and non-economic compensation. They can help you figure out how much money to request, too.
In a personal injury lawsuit, you can request economic damages based on lost wages, medical bills, and other quantifiable losses. Comparatively, you can ask for non-economic damages based on pain, suffering, and other subjective losses. Ultimately, the economic and non-economic damages you seek in your case may total thousands of dollars.

How to Sue if a Family Member Is Killed in a Bus Accident
In instances where a family member dies in a bus accident, you can seek compensation on behalf of your loved one. This requires you to file a wrongful death lawsuit. You can ask for money based on any losses you incur relating to your family member’s death.
For example, a family member may provide money that you use to cover your costs for housing, groceries, and other daily essentials. If this family member dies in a bus accident, you will suffer financial consequences. Fortunately, a wrongful death lawyer can help you sue anyone that caused your family member’s death.
By meeting with an attorney who has wrongful death case experience, you can sue a bus driver and their employer based on the death of your family member. Your lawyer will file your lawsuit and build a compelling argument. If your case is successful, you may be awarded damages.
